In this Privacy Policy, Starlight and Sunny Inc. SuccessMNSTR®  ("Company," "we," "us," or "our") refers to the company that operates the SuccessMNSTR® and The Hidden Rules Expert brands, websites, products and services.

This Privacy Policy explains how we collect, use, disclose, store and protect personal information when you access or use our Services. Our commitment is to safeguard your privacy and maintain transparency in how we handle your personal information.

For this Privacy Policy, our “Services” include:

- our websites, landing pages, funnels, subdomains and other online experiences;

- our quizzes, self-assessments, the SuccessMNSTR® Toolkit (the “Toolkit”), and other digital products;

- our coaching, practitioner directory, referral services and related support; and

- our emails, newsletters, marketing communications and other interactions with us.

This Policy applies to our websites, including:

2.  Information we collect

together with their sub-domains, landing pages, funnels and successor sites (collectively, the “Sites”), and the other Services described above.

By using the Services, you agree to the data practices described in this Policy, subject to any rights or choices available to you under applicable law. Your use of certain Services may also be subject to our Terms of Service, Member Agreement or other applicable terms.

We collect information you provide to us, information we collect automatically when you use our Sites, and information we receive from third parties.

a.  Information you give us:
  Contact and account information. This includes information such as your name, email address, mobile phone number billing address, login information and account details.

   Quiz and self-assessment information. This includes quiz answers, archetype quiz results, health index answers, tool-picker answers, and related self-assessment responses.

   Payment information. Payments are processed by our third-party payment processor. We do not collect or store full payment card numbers. See Section 8 (Payments).

  Communications and support information. This includes emails, support requests, survey responses, testimonials, feedback and other information you choose to send us.

   E-signature information. If you electronically sign our Member Agreement or similar documents, this information includes your name, address, IP address, time-stamp and  signature confirmation.

   Coaching and scheduling information. If you book or attend our one-to-one or group coaching, we collect your scheduling and contact details, your attendance, and information you choose to share during sessions.

b.  Information we collect automatically

When you visit or use our Sites, we and our service providers may automatically collect information such as:

    IP address;

    browser and device type;

    the pages you view;

    referring/exit pages;

    dates and times of access;

    Interaction with pages, links, forms and landing pages;

    cookie and tracking information.

We use analytics and session-replay/heatmap tools (currently Google Analytics and Microsoft Clarity) that record how visitors interact with our websites so we can understand and improve them.

c.  Information we receive from third parties

We may receive information from third parties, including:

    analytics and performance data from website, quiz, automation, and marketing tools;

    campaign, conversion and advertising measurement data from platforms such as Meta, Google, LinkedIn, and YouTube; and

    payment, subscription, refund, and transaction information from payment processors.

We do not buy, rent, scrape or otherwise acquire marketing lists.

d.  Coaching sessions and recordings

If you participate in one-to-one or group coaching, sessions may be delivered by video, phone, or in person. We may record coaching sessions for quality assurance, internal training, continuity of support, or to make the session available for your own review. Recordings may include your voice, image and anything you choose to share during the session.

Before recording, we will notify participants and seek consent where required. If you are in a group session and do not wish to be recorded, please tell your coach before the session begins. We will try to accommodate you where reasonably possible, which may include asking you to keep your camera off, participate only in non-recorded portions, or use another reasonable alternative.

We keep coaching recordings confidential and do not post or publicly distribute them. If you participate in group coaching or a group program, other participants may see, hear, or read what you choose to share. We ask all participants to respect confidentiality, but we cannot control what other participants do with information shared in a group setting.

Please do not share information in group coaching that you would not want other participants to know. We are not responsible for the statements, advice, conduct or confidentiality practices of other participants.

3.  How we use your information

We use personal information to:
provide the Toolkit quizzes, digital products, coaching, and other Services;

     create and manage accounts;

     process purchases, subscriptions, refunds, receipts, and tax records;

     respond to questions and provide support;

     send newsletters, updates, and marketing messages, where permitted;

     operate, secure, analyze and improve our websites, quizzes, products, and Services;

     prevent fraud and abuse;

     understand our audience and improve our content, messaging, products, and user experience;

     measure, deliver, and optimize advertising;

     operate our practitioner directory and referral service;

     communicate with independent practitioners when you request a referral;

     enforce our terms and agreements;

     comply with legal, tax, accounting, and regulatory obligations; and

     protect our rights, users, business and the public.


We may add new features over time, such as memberships, communities, additional coaching services or enterprise offerings. If we make material changes to how we collect or use personal information, we will update this Privacy Policy.

4. Consent and legal bases

We rely on consent where required, including for marketing emails and certain non-essential cookies or tracking technologies.

We also use personal information where necessary to provide the Services you request, to operate and improve our business, to protect our rights and users, and to comply with legal obligations.

We limit our collection, use and disclosure of personal information to purposes that a reasonable person would consider appropriate in the circumstances.

5. Cookies, analytics, and tracking technologies

We and our service providers use cookies, pixels, tags, and similar technologies on our Sites for the following for purposes:

(i)    Essential functions. These technologies help our Sites and Services function;

(ii)    Analytics and performance. These technologies, such as Google Analytics and Microsoft Clarity, help us understand how visitors use our website and improve user experience;  

(iii)    Advertising and conversion tracking. Technologies, such as the Meta Pixel, Google tags, Google/YouTube Ads tools and similar technologies, which help us measure advertising performance, optimize campaigns and understand conversion.

We use a cookie-consent banner on relevant pages to allow visitors to make choices about non-essential cookies where required. You can also control cookies through your browser settings. If you disable certain cookies, parts of the Sites or Services may not work properly.

We may use advertising pixels and tracking technologies on public marketing pages, landing pages and sales pages. See Section 14 (Quiz, self-assessment and wellness information) for how we handle quiz and health-index data in relation to advertising.

6.  Advertising

We advertise on platforms such as Facebook/Instagram, LinkedIn and Google and YouTube. These platforms may use cookies, pixels and tags on our Sites to measure ad performance, optimize ad delivery, and track conversions.

We may also create “custom audiences” by providing certain customer or subscriber information (such as a hashed email address) to these platforms so that we can show ads to you, or to people like you.

Some privacy laws may treat this type of activity as “targeted advertising” or “sharing,” or similar concept, even though we do not sell your personal information for money. Quiz and health-index data are handled separately — see Section 14 (Quiz, self-assessment and wellness information).

Your advertising choices: You can manage advertising preferences through:

·   Your browser cookie settings;

·   Adjusting your ad and privacy settings directly on each platform (e.g., on Facebook, Instagram, LinkedIn, Google, or YouTube);

·   Using industry opt-out tools at optout.aboutads.info and optout.networkadvertising.org and youradchoices.ca;

·    Emailing us at [email protected] asking us to remove your information our custom-audience lists where reasonably possible.

7.  Practitioner directory and referrals

Our practitioner directory may include independent third-party practitioners, such as therapists, somatic practitioners, breathwork practitioners, or other wellness-related providers.

If you ask us to refer you to a practitioner, or if you choose to connect with a practitioner through our directory, we may share the information reasonably needed to make that introduction.

Practitioners listed in our directory are independent third parties. They are not our employees or agents, and they are responsible for their own services, advice, privacy practices and legal compliance.

Once we connect you with a practitioner, their handling of your information is governed by their own privacy policy and practices.

We may receive a referral fee, affiliate fee, commission or similar compensation in connection with referrals.

8.  How we share information

We do not sell your personal information for money. We also do not sell, rent or trade email lists as a standalone business practice.

We may share personal information in the following ways:

     Service providers. We share information with service providers who help operate our business, including providers for:

     website hosting and website operation;

     CRM, email and marketing automation;

     checkout and e-signature;

     quizzes and surveys;

     payment processing;

     analytics and performance tracking;

     advertising and conversion tracking;

     video conferencing and coaching delivery;

     automation and integrations; customer support and administration

These providers may access personal information only as needed to provide services to us, subject to their own legal obligations and contractual terms.

     Advertising and analytics partners. We share limited personal information with advertising and analytics partners as described in Section 6 (Advertising) above.

     Practitioner directory and referrals. We share information with practitioners as described in Section 7 (Practitioner Directory and Referrals) above.

     Business transfers. If all or part of our business is sold, merged, financed, reorganized or transferred, personal information may be disclosed or transferred as part of that transaction. Any such transfer would be subject to this Privacy Policy or another policy that provides notice of the applicable practices.

     Legal, safety and rights. We may disclose personal information where we believe it is reasonable and necessary to:

     comply with law and legal process;

     respond to lawful requests;

     enforce our terms, agreements, or policies;

     prevent fraud, abuse or security issues; and

     protect our rights, property or safety of our users, the public or our business.

9.  Payments

Payments are processed by third-party payment processors. We currently use Stripe through GoHighLevel and may use PayPal, digital wallets, alternative payment portals or other payment providers in the future.

We do not collect or store your full card number. Payment processors handle payment details directly and provide us with transaction information needed to complete your purchase, manage subscriptions, issue refunds, keep business records and comply with tax and accounting obligations.

10.  Where your information is processed

We are based in British Columbia, Canada.

Our service providers may store, access and process information in Canada, the United States and other countries where they or their sub processors operate. For example, GoHighLevel stores and processes customer data in the United States.

By using the Services, you understand that your information may be processed outside the province, state or country where you live. Those locations may have privacy and data-protection laws that differ from those in your jurisdiction.

Where service providers process personal information on our behalf, we remain accountable for that information as required by applicable law.

11.  How long we keep your information

We keep personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

As a general guide:

     Customer accounts and Toolkit data are kept while your account is active, and for approximately two years after it becomes inactive, after which it is deleted or anonymized;

     Quiz leads who do not purchase may be kept up to about twenty four months;

     Newsletter subscriber information is kept until the person unsubscribes or asks us to delete it, subject to any legal recordkeeping requirements;

     Payment, transaction and tax records are kept for approximately six to seven years, or as required by tax and accounting laws;

     Support emails are generally kept for two years;
Coaching session recordings are kept only as long as reasonably needed for the purposes for which they were recorded. These are general guidelines and may vary depending on our providers systems, backups, legal obligations and legitimate business needs.

12.  How we protect your information

We take reasonable steps to protect personal information, including strong, unique passwords and two-factor authentication on our key accounts where available, limiting access to personal information to the owner and essential helpers, relying on established third party providers built-in security controls, requiring contractors or helpers with access to personal information to handle it confidentially and only for business purposes, and not storing card numbers ourselves.

No method of storage or transmission or storage is completely secure. We cannot guarantee absolute security. Email is not a secure medium, so please take care when sending sensitive information by email.

13.  Your choices and rights

Everyone

     Marketing opt-out: click “unsubscribe” in any marketing email, or email us at [email protected]. You may still receive service-related messages about your account, purchases, subscriptions, legal notices or important updates.

     Access, correction and deletion: you may ask us to access, correct or delete your personal information by emailing [email protected]. To protect your privacy, we may need to verify your identity before responding. For example, we may ask you to send a message from the email address on your account. We will respond within the time required by law.

     We may keep information we are required or permitted by law to keep (for example, tax records).

Canadian residents

You may request access to and correction of your personal information under Canadian privacy law (If you have a concern we cannot resolve, you may contact the Office of the Privacy Commissioner of Canada or your provincial commissioner.

U.S. residents

Depending on your state and to the extent a state privacy law applies to us, you may have rights to access, delete or correct your personal information, and to opt out of “targeted advertising” or the “sharing” of your information for advertising. We honor these rights to the extent required by applicable law; to exercise them, email us at [email protected].

We do not currently respond to browser “Do Not Track” signals because there is no uniform industry standard for those signals. Some jurisdictions may require recognition of other opt-out preference signals, and we will honor such signals to the extent required by applicable law and supported by our systems.

14.  Quiz, self-assessment and wellness information

Our Services may include quizzes, self-assessments, tool-pickers, health-index tools and other wellness-related features.

The archetype quiz may collect your name, email address, and quiz answers. The in-Toolkit health index and tool-picker quizzes are designed to collect your answers and provide results without requiring your name or email address, although our quiz platform may show anonymous results and analytics. We and our authorized staff may access quiz-platform results and analytics where needed to operate, understand, and improve the Services.

Our content, quizzes, and Services may address topics such as stress, burnout, mood, high performance, “post-success” wellbeing, personal development, and wellness.

We are not a healthcare provider, and the Services are not medical, psychological, psychiatric, therapy, counselling or crisis services. The Services are not intended to diagnose, treat, cure, or prevent any medical or mental health condition.

If you are experiencing a medical or mental health emergency, or you believe you may be in crisis, please contact emergency services or an appropriate crisis-support resource in your area.

If you ask us to connect you with a practitioner through our directory (for example, a therapist, somatic or breathwork practitioner), we share only the contact details needed to make that introduction, at your request; those practitioners are independent and handle your information under their own privacy policies.

We may collect quiz answers, self-assessment answers or other wellness-related information you choose to provide. We may review this information internally to operate, support, analyze, and improve the Services. Where practicable, we use this information in aggregate, or de-identified form to understand our audience and improve our content, products and user experience.

We do not actively monitor your quiz or health-index answers in real time. We do not sell quiz answers, health index results, or wellness self-assessment answers. We do not upload them to advertising platforms or use them to build advertising audiences, custom audiences, or lookalike audiences.

15.  Children

You must be at least 18 years old (or the age of majority where you live) to use the Services or hold an Account.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it. If you believe a child has used the Services or given us personal information, please contact us at [email protected].

16.  Third-party links

The websites and Services may link to third-party websites, platforms, practitioners, payment providers, social media platforms, or other services we do not control. We are not responsible for the content or privacy practices, security or conduct of third parties. Please review their privacy policies and terms before providing information to them.

17.  Changes to this Policy

We may update this Policy from time to time.

When we do, we will change the “Last updated” date above and post the revised version on the websites. If we make material changes, we may also notify subscribers or users by email or through the Services.

The most current version posted on our websites applies to your use of the Services from the date it is posted, unless we state otherwise or applicable law requires a different approach.
